About Clearbell

Clearbell is a website health monitoring service operated by Simon Taylor, trading as Clearbell, United Kingdom. References to "Clearbell", "we", "us" or "our" in these Terms refer to Simon Taylor trading as Clearbell.

By subscribing to Clearbell you agree to be bound by these Terms of Service. Please read them carefully before subscribing.

The Service

Clearbell provides a monthly website health monitoring service. Depending on your subscription plan, the service may include:

The specific features included in your subscription are determined by the plan you select at the time of purchase. We reserve the right to adjust plan features with reasonable notice to existing subscribers.

Clearbell is a monitoring and reporting service. We identify issues and explain how to fix them โ€” we do not make changes to your website directly unless you have separately engaged us to do so.

Subscriptions and Payment

Billing

Clearbell is offered on a recurring subscription basis, billed either monthly or annually depending on the plan you select. Payment is processed securely through Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis until you cancel.

Pricing

Current pricing is displayed on our website at clearbell.io. Prices are shown exclusive of VAT where applicable. We reserve the right to change our prices with 30 days' notice to existing subscribers. Continued use of the service after a price change takes effect constitutes acceptance of the new pricing.

Annual subscriptions

Annual subscriptions are billed upfront for a full year. If you cancel an annual subscription, you will retain access to the service until the end of your paid period. We do not offer pro-rata refunds on annual subscriptions except as required by law.

Promotional pricing

Promotional or founding rates are subject to their stated expiry terms. After any promotional period ends, subscriptions will continue at the standard rate displayed on our website at that time. We will notify you before any such change takes effect.

Failed payments

If a payment fails, we will attempt to retry the charge. If payment remains outstanding after reasonable attempts, we reserve the right to suspend or cancel your subscription.

Cancellation and Refunds

Cancellation

You may cancel your subscription at any time through your Stripe billing portal or by contacting us at hello@clearbell.io. Cancellation takes effect at the end of your current billing period. You will continue to receive the service until that date.

Refunds

We do not offer refunds for partial months of service. If you believe you have been charged in error, please contact us at hello@clearbell.io within 14 days of the charge and we will investigate.

Under the Consumer Rights Act 2015 and related legislation, you may have statutory cancellation rights if you are a consumer. If you are purchasing as a business, these statutory rights may not apply.

Our Responsibilities

We will use reasonable skill and care to provide the Clearbell service. Specifically, we will:

Service availability

We aim to maintain a high level of service availability but do not guarantee uninterrupted service. Scheduled maintenance, circumstances beyond our control, or third-party service failures may occasionally affect service delivery. We will endeavour to notify you of planned downtime in advance where possible.

Accuracy of reports

Our reports are generated using automated tools and AI-assisted analysis. While we take care to ensure accuracy, reports are provided for informational purposes only. We do not guarantee that our analysis is complete or error-free, and you should exercise your own judgement before acting on any recommendation.

Your Responsibilities

By subscribing to Clearbell, you confirm that:

You agree not to use the Clearbell service for any unlawful purpose or in a manner that could harm Clearbell or third parties.

Intellectual Property

All reports, content and materials produced by Clearbell and delivered to you as part of the service are provided for your personal or business use only. You may share reports internally within your organisation but may not reproduce, resell or distribute them commercially without our written consent.

The Clearbell name, logo and brand materials are our property. You may not use them without our prior written consent.

Limitation of Liability

This section limits our legal liability to you. Please read it carefully.

To the maximum extent permitted by applicable law, Clearbell shall not be liable for:

Our total aggregate liability to you in connection with the service shall not exceed the total fees paid by you in the 12 months preceding the claim.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

Changes to the Service and These Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Your continued use of the service after that date constitutes acceptance of the updated Terms.

We may modify, suspend or discontinue the service or any feature at any time with reasonable notice. If we discontinue the service entirely, we will refund any prepaid fees for unused periods.

Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer based in Scotland or Northern Ireland, you may also have the right to bring proceedings in the courts of your home jurisdiction.
